Terms of Service

1. Acceptance of Terms

By accessing or using Parlivo ("the Service"), operated at parlivo.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the platform. Your continued use after changes constitutes acceptance of the updated Terms.

2. Description of Service

Parlivo is a SaaS platform that helps YouTube creators understand their audience through AI-powered comment analysis. The Service includes:

• Automatic analysis of YouTube video comments (sentiment, themes, topics)
• AI-generated audience insights and content ideas
• RAG-powered chat to ask questions about your comments
• Audience persona identification
• Suggested reply generation

3. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 16 years old to use the Service
• One person or entity may not maintain more than one free account
• You are responsible for all activity that occurs under your account

4. YouTube Data and API Usage

By connecting a YouTube channel, you authorize Parlivo to access public data from that channel via the YouTube Data API v3. You represent that:

• You are the owner or an authorized manager of the YouTube channel(s) you connect
• You have the right to access and analyze the comments on your videos
• You understand that comments are public data posted by third parties

Our use of the YouTube Data API is subject to YouTube's Terms of Service and Google's Privacy Policy. You can revoke Parlivo's access to your Google data at any time via Google Security Settings.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Connect channels you do not own or have authorization to manage
• Attempt to circumvent rate limits, usage limits, or security measures
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use the Service to harass, abuse, or harm others
• Resell, redistribute, or sublicense access to the Service without our written consent
• Use automated tools (bots, scrapers) to access the Service, except through our official API
• Interfere with or disrupt the Service or servers connected to it

6. AI-Generated Content

The Service uses artificial intelligence (Google Gemini, OpenAI) to generate analyses, insights, chat responses, and suggested replies. You acknowledge that:

• AI-generated content is provided for informational purposes only and should not be relied upon as professional advice
• AI outputs may contain inaccuracies, biases, or errors
• You are solely responsible for reviewing and deciding how to use any AI-generated content
• Parlivo does not guarantee the accuracy, completeness, or suitability of AI-generated content
• Suggested replies should be reviewed and edited before being posted on YouTube

7. Subscription and Billing

7.1 Plans

The Service offers free and paid subscription plans. Feature availability and usage limits vary by plan. Current pricing and features are displayed on our billing page.

7.2 Payment

• Payments are processed by Stripe. By subscribing, you also agree to Stripe's terms of service
• Paid plans are billed in advance on a monthly or annual basis
• All prices are in USD unless otherwise stated
• Prices may change with 30 days' notice

7.3 Cancellation and Refunds

• You may cancel your subscription at any time from your account settings
• Upon cancellation, you retain access to paid features until the end of your current billing period
• We do not provide refunds for partial billing periods
• If you downgrade, the change takes effect at the start of the next billing period

8. Intellectual Property

• The Service, including its design, code, branding, and documentation, is owned by Parlivo and protected by intellectual property laws
• You retain ownership of your YouTube content and data
• You grant Parlivo a limited license to process your data solely to provide the Service
• AI-generated analyses and insights derived from your data are yours to use

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

10. Service Availability

• We strive to maintain high availability but do not guarantee uninterrupted access
• The Service may be temporarily unavailable for maintenance, updates, or reasons beyond our control
• We rely on third-party services (YouTube API, AI providers, hosting) that may experience outages
• We are not liable for any loss resulting from service downtime

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, express or implied
• Parlivo shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not responsible for decisions you make based on AI-generated content

12. Indemnification

You agree to indemnify and hold harmless Parlivo and its team from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

• You may delete your account at any time from your account settings
• We may suspend or terminate your account if you violate these Terms
• Upon termination, your data will be deleted in accordance with our Privacy Policy
• Sections that by their nature should survive termination will remain in effect (including liability, indemnification, and dispute resolution)

14. Governing Law

These Terms are governed by and construed in accordance with the laws of France. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of France.
